Article 1 – Scope of Application

1.1 These general terms and conditions govern the remote sale of products marketed by Masalab di Manuel Scarpa, registered office: B.S. Giovanni 565, 30015 Chioggia, Venice, Italy. VAT No. 04737450272.
1.2 Purchases are made through the website www.manuelscarpa.com. The consumer declares that they have read and accepted these Terms before placing an order.

Article 2 – Products and Availability

2.1 The products are artisanal, fresh, and subject to natural weight loss.
2.2 The website indicates product availability; if a product becomes unavailable after the order is placed, Masalab will notify the consumer and may offer a refund or an equivalent product.

Article 3 – Prices and VAT

3.1 All listed prices include VAT.
3.2 Shipping costs are subject to specific conditions and are shown before final order confirmation.
3.3 The following notice applies and is displayed in the footer:
“All prices include VAT. VAT on products is 10%, VAT on shipping costs is 22%.”

Article 4 – Orders and Pre‑Order Payments

4.1 The order is considered complete once Masalab has received confirmation of successful payment.
4.2 All products are sold under a pre‑order system: shipments and in‑store pickup will begin on 1 December 2025. After payment, the order status will appear as “Pre‑ordered”.
4.3 Payment may be made by card, PayPal, or other available methods. Ownership of the product remains with Masalab until full payment and shipment have been completed.

Article 5 – Shipping and Delivery

5.1 Shipments are available to Italy and EU countries. Indicated delivery times are approximate.
5.2 Shipping rates are as follows:
• €11 up to 1 kg
• €16 from 1.1 kg to 4 kg

Article 6 – Right of Withdrawal / Returns

6.1 The consumer has the right to withdraw from the purchase within 14 days of receiving the goods, provided the item is returned intact.
Fresh, artisanal, and perishable products may be excluded from the right of withdrawal, unless otherwise specified.
6.2 Return shipping costs are borne by the consumer.
6.3 Once the returned product has been received and verified, Masalab will issue a refund according to the agreed method within 14 days.

Article 7 – Product Warranty

7.1 All products comply with applicable legal standards.
7.2 In case of defects or non-compliance, the consumer must contact Masalab within 2 days of receipt, providing photos. Masalab will arrange a replacement or refund.

Article 8 – Personal Data and Privacy

8.1 Personal data is processed in accordance with EU Regulation 2016/679 (GDPR).

Article 9 – Changes and Updates

9.1 Masalab reserves the right to amend these terms at any time. Updated versions apply from the date of publication on the website.

Article 10 – Applicable Law and Jurisdiction

10.1 The contract is governed by Italian law.
10.2 For consumers residing in Italy, the competent court is that of their place of residence or domicile, in accordance with consumer protection laws.
